Should I Get A Prenup?

Nothing says, “I can’t wait to spend the rest of my life with you!”, quite like a prenuptial agreement.  However, as unromantic and potentially bliss buzz-killing as having a conversation about a prenup can be, more and more Californians are doing just that.  It seems that many soon-to-be-married couples are beginning to understand that a significant number of marriages end in divorce.  Having a prenuptial agreement in place can help lay a financial blueprint or protect assets in the event of a divorce.

Prenuptial agreements aren’t just for the wealthy, the rich and famous.  Those entering a union with children or with a business or inheritance, should all think about having a prenup drafted.

The most important thing to remember is to hire a family law attorney for your prenup.  You may think that you know what should be in your prenup, but an experienced attorney will know all roadblocks and proper language.  Make sure to disclose all assets and liabilities to both your partner and attorney.  Don’t just take the first draft at face value.  If you see something that you don’t agree with or like, speak up.  A little squabble over a change now can greatly affect your life 10, 15, or even 30 years down the line.

While prenuptial agreements typically tend to hold up better in the court system, there has been a recent surge in postnuptial agreements in the last few years. The consensus is that once you are actually married you owe your spouse a much high duty, therefore postnups are harder to enforce.
