Speak with your spouse and find out what areas you agree on and what is bound to cause conflict. Ask questions like: who will remain in the marital home, how will child custody be awarded, what type of time sharing schedule will you follow with your children, will alimony be paid and, if so, by whom and how much? While more than likely you won’t be able to agree on all of these issues without the help of a family law attorney, having the discussion and prioritizing whats most important to you will help in divorce proceedings.
You may also want to seek the help of a certified financial planner who can provide objective financial advice and help you collect important documents like bank statements, tax returns, salary and investment information, and insurance policies. You should also think about opening a bank account in your name at a bank where your spouse does not do business.
Most importantly, however, make sure the marriage is, indeed, irretrievably broken. Exhaust every avenue to decide that you are both sure that divorce is the correct option. If you decide that it is, try to keep the lines of communication open with your spouse. If you can negotiate a divorce settlement without going to court, you will be able to decide what happens on important issues rather than a judge.
